These Terms & Conditions govern the use of the Blue Barrier Waterproofing website and the provision of waterproofing surveys, bathroom tanking, wet room waterproofing, commercial waterproofing and related services.

Please read these terms carefully before instructing us to carry out work.

By accepting a quotation, booking a survey, instructing us to commence work or otherwise entering into an agreement with us, you agree to these Terms & Conditions.

In these Terms & Conditions, references to “Blue Barrier”, “we”, “us” or “our” mean the legal business identified above.

References to “you”, “your” or “customer” mean the individual, company, contractor, developer, property owner or organisation purchasing or requesting our services.

 

2. OUR SERVICES

 

Blue Barrier provides specialist services including:

  • Bathroom tanking
  • Wet room waterproofing
  • Commercial bathroom waterproofing
  • Waterproofing surveys and site assessments
  • Waterproofing preparation and installation
  • Waterproofing of floors, walls and wet areas
  • Waterproof detailing around corners, junctions and penetrations
  • Related waterproofing and project support services

The precise scope of each project will be described in the relevant quotation, proposal, survey booking or written agreement.

 

3. QUOTATIONS

 

Unless otherwise stated, quotations are based on the information available to us at the time they are prepared.

This may include:

  • Drawings
  • Photographs
  • Specifications
  • Dimensions
  • Bathroom or wet-area quantities
  • Site information
  • Customer descriptions
  • Information obtained during a site survey

A quotation will apply only to the works specifically described within it.

Additional work, changes to the scope or unforeseen site conditions may result in additional charges.

Unless the quotation states otherwise, any estimated quantities or measurements may be subject to confirmation once access to the relevant areas is available.

 

4. ACCEPTANCE OF A QUOTATION

 

A contract may be formed when you:

  • Accept our quotation in writing;
  • Confirm acceptance by email or other agreed electronic communication;
  • Pay a requested deposit;
  • Instruct us to book or commence the works; or
  • Otherwise clearly confirm that you wish us to proceed.

Your quotation together with these Terms & Conditions will form the basis of the agreement between you and Blue Barrier.

If there is a conflict between these general terms and a specific written quotation or contract, the expressly agreed project-specific terms will take priority.

 

5. PRICES

 

Prices will be stated in the relevant quotation.

We will make clear whether VAT is applicable to the quoted amount.

Unless expressly included in writing, the price does not automatically include additional works such as:

  • Removal of existing tiles or finishes
  • Structural repairs
  • Plumbing alterations
  • Electrical works
  • Tiling
  • Carpentry
  • Substrate replacement
  • Drying or remediation of existing water damage
  • Asbestos investigation or removal
  • Specialist access equipment
  • Parking, permits or congestion-related charges
  • Works outside the agreed scope

Any additional work must be agreed before it is undertaken wherever reasonably practicable.

 

6. DEPOSITS AND PAYMENT

 

Where a deposit or advance payment is required, the amount and payment date will be stated in the quotation or invoice.

Remaining balances must be paid according to the agreed payment schedule.

For larger projects, staged payments may be required as works progress.

Invoices must be paid by the due date shown on the invoice unless another payment arrangement has been agreed in writing.

For business-to-business transactions, Blue Barrier reserves the right to claim statutory late-payment interest and applicable debt-recovery costs where legally available. Current UK rules permit statutory interest on qualifying commercial debts at 8% above the Bank of England base rate, unless an applicable contractual remedy replaces it.

 

7. WATERPROOFING SURVEYS

 

A waterproofing survey is an assessment of the conditions visible and reasonably accessible to us at the time of inspection.

Depending on the project, a survey may consider:

  • Existing substrates
  • Floor and wall construction
  • Shower and wet areas
  • Corners and junctions
  • Pipe and service penetrations
  • Existing visible defects
  • Proposed layouts
  • Drawings and specifications
  • Proposed waterproofing requirements

Unless expressly agreed otherwise, a waterproofing survey is not a structural survey, building survey, drainage survey, asbestos survey, electrical inspection or invasive investigation.

We cannot be responsible for defects or conditions that were concealed, inaccessible or not reasonably apparent during the survey.

 

8. SITE ACCESS

 

You must provide reasonable and safe access to the property and the areas where the works are to be undertaken.

Where applicable, you are responsible for ensuring that:

  • Appropriate site access has been arranged;
  • The working area is available at the agreed time;
  • Other trades do not obstruct the waterproofing works;
  • Relevant utilities are available where required;
  • Required permits or permissions have been obtained;
  • We have been informed of relevant site rules and hazards.

Where access is unavailable or the site is not ready at the agreed time, we may need to reschedule the works.

Reasonable additional costs arising from aborted visits, waiting time or additional attendance caused by circumstances outside our control may be charged where those costs have been explained and are appropriate in the circumstances.

 

9. SITE CONDITIONS

 

Waterproofing relies on suitable surfaces and appropriate preparation.

If, after work begins, we discover conditions that could not reasonably have been identified beforehand, we will explain the issue and any recommended additional work.

Examples may include:

  • Unsuitable or unstable substrates
  • Hidden water damage
  • Excessive moisture
  • Cracks or movement
  • Poor previous workmanship
  • Contaminated surfaces
  • Loose boards
  • Inadequate falls
  • Plumbing defects
  • Structural defects
  • Hidden penetrations
  • Unexpected construction details

We will not normally proceed with materially additional chargeable work without discussing it with you first.

 

10. SUBSTRATE PREPARATION

 

The substrate must be suitable for the waterproofing system being installed.

Depending on the project, appropriate substrates may include timber floors, concrete floors, block walls, timber stud walls, cement boards and tile backer boards.

The suitability of any particular surface will depend on its condition, construction and the waterproofing system being used.

Where additional preparation or repair is required, this may form part of an agreed variation or additional quotation.

 

11. WATERPROOFING INSTALLATION

 

We will carry out the agreed waterproofing works using reasonable care and skill.

For consumer contracts, UK law implies that services must be performed with reasonable care and skill; where timing or price has not been fixed, additional statutory rules can require performance within a reasonable time and for a reasonable charge.

Waterproofing systems will be installed in accordance with the agreed specification and applicable manufacturer instructions, subject to site conditions.

 

12. NHBC GUIDANCE AND OTHER STANDARDS

 

Where our website or quotation refers to NHBC Guidance 9.2 or another standard, guidance document or manufacturer specification, this means the relevant system and installation are intended to be carried out in accordance with the applicable stated requirements.

Unless expressly agreed in writing, Blue Barrier does not provide building-control approval, NHBC certification or approval on behalf of any third-party organisation.

Responsibility for obtaining any required project approvals remains with the party responsible for the wider development unless otherwise agreed.

 

13. OTHER TRADES

 

Once our waterproofing works are completed, subsequent trades must avoid damaging the installed system.

This includes tilers, plumbers, electricians, carpenters and other contractors working in the area.

Blue Barrier cannot accept responsibility for damage caused to completed waterproofing by another contractor, customer or third party after the area has been handed over.

If we are asked to return and repair third-party damage, this may be treated as additional chargeable work.

 

14. READY FOR TILING

 

Where we describe an area as “ready for tiling”, this means the agreed waterproofing works have been completed sufficiently for the appropriate next construction stage, subject to relevant curing times and manufacturer requirements.

The tiling contractor remains responsible for checking that the surface is suitable for their own materials, adhesives, tiles and installation method.

 

15. PROJECT PROGRAMMES

 

We will make reasonable efforts to attend and complete works according to the agreed programme.

Construction programmes can, however, be affected by circumstances outside our reasonable control.

These can include:

  • Delays by other trades
  • Site access problems
  • Unsuitable substrates
  • Changes in project scope
  • Material availability
  • Adverse weather where relevant
  • Transport disruption
  • Illness
  • Building or utility issues
  • Events outside our reasonable control

Where delays occur, we will communicate with you and arrange revised dates as reasonably necessary.

 

16. CUSTOMER CHANGES AND VARIATIONS

 

If you request changes after a quotation has been accepted, we may issue a variation or revised quotation.

Changes can affect:

  • Price
  • Materials
  • Labour
  • Programme
  • Number of visits
  • Completion dates

Any material variation should be agreed before the additional work is carried out wherever reasonably practicable.

 

17. CANCELLATION BY CONSUMERS

 

If you are acting as a consumer, statutory cancellation rights may apply where your contract was made at a distance, such as online or by telephone, or in certain circumstances away from our business premises.

For many qualifying distance or off-premises service contracts, the statutory cancellation period is 14 days.

These statutory rights are separate from any additional cancellation rights we may offer.

18. WORK REQUESTED DURING THE 14-DAY CANCELLATION PERIOD

 

You may ask us to begin a qualifying service before the 14-day cancellation period has expired.

Where the law requires it, we will obtain your express request to begin early.

If you subsequently exercise a valid cancellation right after work has started at your express request, you may be required to pay a proportionate amount for the service already supplied.

Where a service has been fully performed during the cancellation period following the consumer’s express request and required acknowledgement, the statutory cancellation right may be lost.

This may be particularly relevant to rapidly arranged waterproofing surveys or urgent works.

 

19. OTHER CUSTOMER CANCELLATIONS

 

Where no statutory cancellation right applies, or where it has expired, please notify us as soon as possible if you need to cancel or postpone booked work.

Depending on how late the cancellation occurs and the costs already incurred, we may charge reasonable amounts reflecting matters such as:

  • Materials specifically ordered for the project;
  • Non-refundable third-party costs;
  • Work already completed;
  • Labour or resources reasonably committed to the project; and
  • Other losses we cannot reasonably avoid.

We will not impose an arbitrary or disproportionate cancellation penalty. UK consumer guidance specifically warns against excessive cancellation charges and automatic forfeiture of all upfront payments where that would be unfair.

 

20. CANCELLATION BY BLUE BARRIER

 

We may suspend or cancel work where there is a legitimate reason, including where:

  • Payment is materially overdue;
  • The working environment is unsafe;
  • Required access is repeatedly unavailable;
  • We discover conditions that make the proposed work unsafe or inappropriate;
  • You materially breach the agreement;
  • You request work that would be unlawful or contrary to appropriate professional or manufacturer requirements; or
  • Circumstances genuinely outside our reasonable control make performance impossible.

Where you are not at fault and we cannot provide the agreed service, we will deal fairly with any payment received for work that has not been provided. Consumer contract cancellation provisions must not unfairly give a trader disproportionate cancellation rights or permit unjustified retention of prepayments.

 

21. MATERIALS

 

Materials may vary slightly in appearance, packaging or specification where manufacturers update their products.

Where a particular manufacturer or system is expressly specified, we will use reasonable efforts to use that product.

If it becomes unavailable, we will discuss any materially different alternative before substitution.

Materials remain our property until paid for to the extent permitted by law and practical circumstances.

 

22. WARRANTIES

 

Any specific workmanship or product warranty applicable to your project will be stated in your quotation, invoice, handover documentation or separate warranty documentation.

Manufacturer warranties, where available, are subject to the relevant manufacturer’s own conditions.

Nothing in these Terms & Conditions removes statutory rights that cannot lawfully be excluded.

 

23. CUSTOMER RESPONSIBILITIES AFTER INSTALLATION

 

Customers and subsequent contractors should follow any instructions given regarding:

  • Curing or drying periods
  • Protection of completed areas
  • Subsequent tiling
  • Drilling or fixings
  • Alteration of waterproofed surfaces
  • Plumbing penetrations
  • Maintenance

Drilling, cutting or otherwise penetrating an installed waterproofing system may compromise its integrity.

Contact us before altering a waterproofed area if you are uncertain.

 

24. DEFECTS AND PROBLEMS

 

If you believe there is a problem with work carried out by Blue Barrier, contact us as soon as reasonably possible and provide details of the issue.

Where appropriate, we may arrange an inspection.

You should give us a reasonable opportunity to investigate an alleged defect before instructing another contractor to alter or remove the relevant work, except where urgent action is reasonably necessary to prevent damage or address a safety issue.

Nothing in this section limits consumer statutory remedies.

 

25. OUR LIABILITY

 

Nothing in these Terms & Conditions excludes or restricts liability where it would be unlawful to do so.

In particular, these terms are not intended to exclude liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded. Consumer terms cannot validly remove mandatory statutory protections.

Subject to those protections, we will not be responsible for loss or damage caused by:

  • Pre-existing defects;
  • Hidden or inaccessible defects;
  • Structural movement;
  • Defective plumbing;
  • Failure of surfaces outside our scope;
  • Damage caused by another contractor;
  • Unauthorised alterations after our work;
  • Failure to follow instructions;
  • Matters outside the agreed waterproofing scope; or
  • Circumstances we could not reasonably have prevented.

For business customers, any additional contractual limitation of liability stated in an accepted quotation or commercial agreement will also apply subject to applicable law.

 

26. CONSEQUENTIAL BUSINESS LOSSES

 

Where you are contracting with us wholly for business purposes, and subject to applicable law and any project-specific agreement, we will not be liable for indirect or consequential business losses that were not reasonably foreseeable as a result of our breach.

Nothing in this clause applies where liability cannot legally be limited.

 

27. PHOTOGRAPHS AND PROJECT RECORDS

 

We may take photographs of works for:

  • Project records
  • Quality control
  • Documentation
  • Evidence of substrate or site conditions
  • Warranty or dispute purposes

We will not intentionally publish information that identifies a private customer or private address for promotional purposes without an appropriate lawful basis or permission.

Any marketing use involving identifiable individuals will be handled in accordance with our Privacy Policy.

 

28. INTELLECTUAL PROPERTY

 

The content of the Blue Barrier website, including branding, text, graphics, designs and original photographs, is owned by or licensed to Blue Barrier unless otherwise stated.

You may view and use the website for ordinary personal or business enquiry purposes.

You may not reproduce, republish or commercially exploit our content without permission where intellectual-property rights apply.

 

29. WEBSITE INFORMATION

 

We aim to keep information on our website accurate and up to date.

However, website content is general information and does not replace a project-specific inspection, specification or quotation.

Waterproofing requirements vary according to construction, substrate, layout, use and site conditions.

A statement on the website should therefore not be treated as confirmation that a particular system is suitable for a particular property without appropriate assessment.

 

30. WEBSITE AVAILABILITY

 

We do not guarantee that the website will always be uninterrupted or free from technical errors.

We may update, suspend or change parts of the website from time to time.

 

31. THIRD-PARTY LINKS

 

Our website may contain links to external websites or services.

We are not responsible for the content, availability or terms of websites that we do not control.

 

32. PERSONAL INFORMATION

34. CONSUMER RIGHTS

 

If you are a consumer, nothing in these Terms & Conditions affects your statutory consumer rights.

UK consumer services must be performed with reasonable care and skill, and businesses cannot simply contract out of mandatory consumer protections.

 

35. BUSINESS CUSTOMERS

 

If you are entering into the agreement in the course of a business, trade or profession, you confirm that you have authority to bind the organisation on whose behalf you are acting.

Project-specific purchase orders, subcontract agreements or commercial terms will only override these Terms & Conditions to the extent expressly agreed by Blue Barrier in writing.

 

36. TRANSFER OF THE AGREEMENT

 

We may use appropriately qualified employees, subcontractors or specialist service providers to carry out parts of the agreed work.

Blue Barrier remains responsible for the services we have contracted to provide, subject to the terms of the agreement.

You may not transfer your rights or obligations under the agreement to another party without our agreement where doing so would materially affect performance of the contract.

 

37. EVENTS OUTSIDE OUR CONTROL

 

Neither party will be treated as being in breach solely because performance is delayed or prevented by circumstances genuinely outside that party’s reasonable control.

Where such circumstances occur, we will communicate with you and make reasonable efforts to minimise disruption and rearrange the works.

 

38. SEVERABILITY

 

If a court or competent authority decides that any provision of these Terms & Conditions is invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

 

39. NO WAIVER

 

If either party does not immediately enforce a contractual right, this does not necessarily mean that the right has been waived.

 

40. THIRD-PARTY RIGHTS

 

Unless expressly stated otherwise, these Terms & Conditions are intended to govern the agreement between Blue Barrier and the customer and are not intended to give contractual enforcement rights to unrelated third parties.

 

41. GOVERNING LAW

 

These Terms & Conditions and contracts with Blue Barrier are governed by the laws of England and Wales, subject to any mandatory consumer protections that may apply.

For business contracts, the courts of England and Wales will have jurisdiction unless another arrangement is expressly agreed.

For consumers, nothing in this clause is intended to remove any mandatory rights relating to where legal proceedings may properly be brought.

 

42. CHANGES TO THESE TERMS

 

We may update these Terms & Conditions from time to time.

The terms applicable to a particular project will generally be those in force or otherwise supplied when the relevant agreement is entered into, unless a later change is expressly agreed.

The latest website version will display the date it was last updated.
